the question asks which justification violates the standards. i put down c which I thought was a surefire correct answer. Turns out I’m wrong. the correct answer is a.
why is c not correct? I understand that its ok to say that every member passed each level of the cfa examination on the 1st attempt if that’s true but its not ok to use that as a promise of superior performance which is exactly what this question is saying it is used for. the words “including the following justifications for why the firm should win the tender”- isn’t this saying “we would win the tender b/c we have folks who passed the examination on the first attempt”- isn’t that a violation? I am so confused about this question.
It’s cause they are claiming superiority over anyone who’s not a CFA charterholder which is a violation of std 7B.

There’s no violation of the standards, for a reason the author of the question didn’t consider.

You cannot violate the Code and Standards if they don’t apply to you, and they apply only to covered persons (i.e., candidates, charterholders, and members of CFA Institute). In particular, they do not apply to companies. Therefore, Kingfisher Financial Development Partners cannot violate the C&S.
There’s no way i would have gotten this. Thanks Bill. That’s a good nuance. So just to confirm- if a covered person had made that statement I.e. we should win the tender b/c and given the passing on first attempt as a reason then he/she would be in violation of the standards right?
