“California is only the second state to have a law that addresses revenge porn. New Jersey has had a related law since 2003 that makes it a felony to post secretly recorded videos or photos online.”
Apparently, other states think revenge porn is part of first amendment rights. In addition, in California at least:
“(The law) only applies when the person accused of spreading the images online is also the photographer. It does not cover photos a person takes of themselves and shares with a lover, say during a sexting session.”
So hypothetically speaking of course, if the photographer took the pics in CA and released the photos in NV I wonder if this is legal?
Also let’s say a couple from CA is on vacation in another state or country, takes pics, and then the photograper releases the photos when he gets back to CA? I wonder if this is legal? I need to understand this law to protect myself in case I ever need to release the Kraken on some bish.
LOL, kraken.,… I’d assume it’s tied to geographic position, like if you’re in new hampshire, you don’t have to wear a seatbelt, but if you’re from new hampshire and in another state who has seatbelt laws, you must wear a seatbelt.
so, I assume you have to release it from a server in CA, but I aint no lah-yer
Every state likes to exert their power to the largest extent possible, so I’m guessing that CA would pursue charges if there is any connection to CA whatsoever.
