Schweser Ethics Self-Test Q23

Even though 10/25 clients have been rejected by Affinity, is the fact that he is using an Affinity prospect list a violation? I thought that the because the list is from Affinity, and not his new employer, MH, it would be a violation regardless of whether or not the prospective clients had been rejected. Anyone get caught up with this too?

In this particular case, clients were too small for previous employer. Contacting them doesn’t harm the previous employer. No violation.

But wouldn’t using a list that was put together by the former employer, regardless of whether the clients were too small, still a violation, because that list should technically be property of his former employer. Maybe I am looking too into this one though…
