My company has a portfolio model with 1 million $ of its own money invested since 2008, therefore it’s not a paper money track record. It has beaten the benchmark all years except one. My company wants to white label and sell portfolio signals to another financial institution who wants to use all the track record of our model portfolio and put his firm header / name on it and a pic of their portfolio manager along with his description bio . Our company will tell that firm what to buy / sell so he can replicate the model. Is that even legal for him to publish all the track record in his fact sheet or does he have to start the track record from scratch? Or it is okay if there is a disclaimer saying the performance from 2008 to June 2017 is ours and his is after? They would use the model portfolio for segregated accounts.
