The fact that Pistorius will not be sentenced with murder doesn´t mean that he´ll not be sentenced with homicide, which can also imply lots of years in prison.
It may be a low-cost country, but it’s also a country where “men hiding in the bathroom, trying to kill him,” is a common enough occurrence that it is plausible to use as murder defense…
He can be found guilty of culpable homicide - max 15 years, 2 x discharging a firearm in public - max 5 years for each, and illegal possession of ammunition - max 15 years
The saddest part of this story is that there is one less HCB walking on this planet. Which makes it a little more difficult for the rest of us to meet one.
Are people in prison open about these experiences? You know how you go out with your buddies and you talk about all sorts of stuff? When ex-convicts go out, are they like “Hey you guys know that Blade Runner guy? Yeah, I banged him”.
There’s also no jury in South Africa. So basically, one old guy decides if you are guilty or not. Actually, come to think of it, this might not be worse than just getting a bunch of random people to decide.
Now that I think about it, it must be pretty hard to prove without reasonable doubt that Oscar did not actually think that there was an intruder. The story is silly and I don’t believe it at all, but I can see how it can be hard to disprove it.
